security correspondent jennifer griffin reports from the pentagon. >> at 4:50 a.m. on november 1, just days before the u.s. presidential election, two iranian frog foot fighter jets like these intercepted and fired twice upon an unmanned, unarmed u.s. predator drone over the persian gulf. it is the first time the iranians have ever fired on a u.s. drone. the shots missed on both attempts and iran's fighter pilots briefly pursued the drone which land safely at an undisclosed location. >> the incident occurred over international waters, approximately 16 nautical miles off the iranian coast line. our aircraft was never in iranian air space. it was always flying in international air space. the internationally recognized territorial limit is 12 nautical miles off the coast. and we never entered the 12 nautical mile limit. >> asked whether the i want was an act of war, the pentagon spokesman said he would not legally label it, adding the state department had protested through the swiss protective powers, which have represented the u.s. government in tehran since the u.s. embassy takeover in 1979.

and that is the top commander in afghanistan, general john allen. turns out the pentagon is now investigating him as well for sending inappropriate e-mails to jill kelly. now, if you remember from yesterday, kelly is the same woman who sparked this whole investigation because petraeus' mistress paula broadwell was sending her e-mails. allen is saying he did nothing wrong and is maintaining his current position within the military. now, many are wondering why the fbi would get involved if this is nothing more than an affair. but we're now hearing fears of potential security leaks. in a speech at the university of denver broadwell suggested the libya attack was targeting a secret prison at the benghazi consulate. federal agents have been searching broadwell's home. late last night and into early this morning. not only did she have thousands of e-mails between her and petraeus detailing the affair. she also had classified material on her computer. as of yet the fbi doesn't believe that came from petraeus but it is illegal. more bill

the benghazi attack and when he knew it. let's get right to our pentagon correspondent barbara starr. barbara, what are you learning? >> wolf, i have just spoken to someone, a long-standing source who has spoken to david petraeus. this is someone on his level professionally. this person is directly familiar from petraeus with his thinking, with petraeus' thinking about what he will tell congress tomorrow about the benghazi attacks. david petraeus wants to tell congress that he knew almost immediately after the september 11th attacks that the group ansar al sharia, that al qaeda sympathizing group in libya was responsible for the attacks. here's how it goes. in petraeus' view there are two questions on the table. who was responsible? and that is ansar al sharia. he has intelligence he believes to back that up. second question, what was their motivation? that is where some of the confusion may lie. what this source says petraeus told him is there were about 20 intelligence reports that began to come in blaming that video -- that anti-islamic video that sparked the riots in cairo. that's the con
